The Appellate Practice Group at Bishop | Barry has a strong track record of success at the appellate level in state and federal appellate courts. Our attorneys have briefed and argued appeals before the Supreme Court of California and the federal circuit courts, whether brought as appeals from final judgments or as writ procedures on nonappealable orders.

Attorneys in the Appellate Practice Group not only have briefed hundreds of appeals, they have experience as law clerks for appellate justices. This experience provides valuable insight as to how appellate courts work and what are likely to be favorably received arguments.

The expertise of our appellate attorneys is also proactive – we advise our clients in proceedings in trial courts. We are convinced the best way to preserve a favorable decision, or to show error in a lower court’s decision is to develop the record in the lower court. Attorneys in the group advise clients as to jury instructions, motions in limine, verdict forms, and post-trial motions. Where immediate appellate review is required, the attorneys have prepared extraordinary writs to contest a lower court’s ruling or order prior to judgment.
